    Ex owes me money
    My ex-boyfriend owes me money. I helped him out wnen he was three months behind on his mortgagae. I lent him $6250. He is refusing to pay me back. How do I handle this? Do I contact his mortgage company and tell them or do I take him to small claims?

    The mortgage company has NOTHING to do with this. It doesn't matter what he used the money for. If you can prove you made a loan to him, take him to small claims court.

    If you watch Judge Judy or Judge Alex you'd know how this is going to play out. You take him to small claims court and he says he repaid you in cash. Now, where is the proof of his staement or your claim. You will need to be one lucky duck to see this money again. Your best bet is to apply to be on one ofthose TV shows. Both parties financially benefit, no losers.

    Mortgage company is not a party to this - take your records (your bank withdrawal, a check if you gave him a check, whatever other paperwork you have) to Small Claims (and you'll have to check the limit in your State). It will be your word against his.

    If you paid the mortgage company directly they very well may have a record of that.

    You take the signed contract ( loan agreement) you wrote up and have him sign, and take it to small claims court.

    The mortgage company has nothing to do with this what so ever.

    I'm fairly certain there was no formal written agreement so there's the rub. His word againist hers. If she has a cancelled check it may help, especially if there is a memo regarding a loan. Judge might ask the ex since he was 3 months behind where did he get the money. Shifty characters will have an asnwer to that too.
