    My partner wants to adopt my son.
    My son is almost 16months old and has never seen his biological father. He has been is Prison since before I even was far enough along to know that I was pregnant. He is in Prison for CSC w/ a person 13-15. I have a boyfriend that I'm having another baby with and he wants to adopt my son to. But his real father will not sign over his rights. Is there any way we can go though this process with out him signing over my son since he won't be able to be around him anyway when he gets out of prison. My new boyfriend and I are planning on Getting married in October.

    First get married. Next check with the laws in your state about whether there is a required period of marriage before adoption. When you get close to that time, consult an attorney to prepare the adoption petition. The attorney will then know what to do to get the father's rights terminated. Generally incarceration would be accepted.

    Let me ask you this... the bio father that is in prison... is he a decent guy other than the fact that he's locked up or is he an abusive scumbag? If when he gets out he gets a job and actually wants to be there for your son, then in my opinion he deserves a right to be there. But on the other hand, if the bio father is a psycho and it can be backed up with medical records and a mile long police record (like in my case) then keep that baby as far away as u can and do everything in your power to try and go through with getting his rights taken and do the adoption.
