    Possible custody/placement issue
    How do the courts view a possible request for a custody change? My ex husband has a felony for child abuse from 4yrs ago with our Son who is almost 6yrs old. He served jail time and had 4yrs of propation that was up in July 08. He has been arranging things in his life to "look good" in his life, remarraige, desiring more time with our son etc. My gut tells me that he is setting all of this up to prove he is fit to have custody of our son, or at least 50/50 placement and shared custody. My fear is that he will try to prove me as an unfit mother, which I am not, but I put nothing past him to try to come up with something. I have no record, I have provided for my son on my own, I am not rich and don't have a lot and have had to use Food Stamps and state medical in the past for my son and I, but the needs of my Son were always met. He is a happy, healthy boy. Do I have anything to worry about? I have never used drugs and do not drink on a regular basis, I was a stay at home mom for several years until I had to work to support my son on my own. I do have a history of depression from the past relationship with my husband so he would use that against me. But I am OK now. Im just curious what advice is out there, if I have anything to be fearful of or if Im just thinking too much..

    Before I can give a good answer I need to know a few things. Does he have any visitation right now? What state are you in? And Was he in jail for abusing his son? (I think that's what I read but want to make sure)

    The laws on this vary from state to state. But, with his record, the most he can get would be supervised vists. If he proves himself with that, he might be able to get more.

    Your best bet is to document everything to bring to court. But I think it would be very hard for him to wrest custody from you.
