    Taking someone off a mortgage
    My mom and aunt bought a house together about 2 1/2 years ago. Things started well but little by little, my aunt has not been coming up with her share of the bills and my mom is stuck working so much overtime to make up for it. My aunt is a very vindictive person and I know that she is purposely trying to bring the house down. She refuses to leave so that my mom can find a room mate that is able to pay the money that my aunt is not. Is there any way that my mom can get her off the loan or title? If my mom is able to get my aunt's name off the title by going a quit claim deed, will she have the right to kick my aunt out of the house?:confused:

    Your aunt would have to give your mom a deed transferring all of her interest in the house to your mom. It appears highly unlikely that your aunt will do this unless your mom buys it from her.

    A fair method would be to take the current value of the house (the amount that it would sell for in today's market), subtract the current balance of the mortgage and then divide the remaining amount in half. That would be the value of your aunt's share. From that amount your mom should subtract the amounts that she had to pay when your aunt didn't make the payments.

    Your mom could refinance the house in her name only and use the money from the refi to pay off the current loan and pay your aunt her share. At the refi your aunt would give your mother the deed. Then your mom could kick her out and find a roommate to help pay the bills.

    This is what would happen in a perfect world, anyway. :)
