    I want my spouse to adopt my daughter
    I have a 4year old daughter. I have full sole custody of her due to her mom on drugs. Her mom was given supervised visits with drug test before she sees our daughter. Its been a year since she has seen her and 5months since she called. She has not attempted to call or see our daughter. Nor does she pay child support I currently live with my girlfriend who I'v been with for 4years. My daughter now calls her mommy. We both would like to know if my girlfriend is able to adopt my daughter.

    Not unless your ex-wife is a danger to the child or has abandoned her - legal abandonment is dropping her off someplace, not leaving her with you. Not visiting, not paying child support, are not grounds to lose custody. What does your custody/child support order say?

    Of course, she might agree to relinquish custody. In most States you cannot adopt (and she can not surrender custody) unless you are in a stable marriage for a certain period. Girlfriends don't count.

    If your ex-wife is unfit you can always take her to Court, ask for custody and see how it plays out.

    Of course, some of this depends on what State you are in.
