    Probate
    My father just recently passed away. There was no will, and there is nothing but
    A lot of debt on his house and business, I don't want to file probate.I just want to
    Walk away from it.. can my fathers creditors come after me and do I need a attorney?
    My sister is freaking out, wants to hire a attorney and making a big deal out of it
    What should I do? help? Charidy

    Unless you or your sister is on any of the debts, no they can not come after you, Now to do it properly, you should file in probate, sell the house and pay the debts are required ( certain debts are to be paid first depending on your state law) Of course the cost of the attorney if you use one is paid out of the money or sale of property. But you are not required to do anything if you don't want to.
