    Deceased wife's name off deed
    How do I go about taking my decesed wife's name off the deed of our house?

    My Attorney prepared a new Deed running from my late husband and me to me alone.

    How was the deed worded? Joint Tenants with right of survivorship? Who is the executor of her estate?

    Mine was joint with rights of survivor but my Attorney advised that a new Deed be filed now so if/when something happens to me there can be no question, no need to prove two deaths (his and mine) in order to transfer or sell the property. And, yes, I was the Executrix.

    Or maybe the Attorney just needed the extra money.

    If its joint/survivorship, then all that may be necessary is deeding the property to himself and presenting the death certificate. Otherwise he might have to prove he's the executor of the estate.

    This is an estate issue; was the title 'tenants in common' or 'joint tenancy?' Also, did your wife have a child or children? And, did your wife leave a will?
