wife legally commits perjury in Arizona courts
My friend has been in jail for over 7 months due to his x wife who got 911 happy and called the police 136 times with bogus domestic violence accusations in city court. This poor guy got arrested three times for cooperating with police - he didn't know she had filed an order of protection and so he goes to church with donuts like he did every Sunday well she whips out the order and bam he goes to jail.

A superior judge had "meetings" at city court and declared his punishment unjust and unfair for these offenses"

His public pretender told me yesterday "I am bound by the states statutes so I have a limited range of action in which I can take, but you need to get it done" meaning i can't over throw a judge in the higher or there goes my job.

i need to file a substitute or fire a public defender form i know, but any advice??? The x wife used her connections with 88 crime and her boyfriend who is a detective (fired from the police dept. so now a narc) to "set my friend up" to look like a drug addict, alcoholic, mental case oh you name it.

    Hello d:

I don't know what the public defender meant. You don't either. They don't get FIRED for doing their jobs. They get fired for NOT doing their jobs. If the public defender can't do it, then NOBODY can.

I understand you are caught up in the rumors regarding public defenders, but if you throw him overboard NOW, you are throwing your friend too.

There are no "fire public defender forms". You fire him like you fire anybody else. You say to him, "you're fired".

I would ask the pd, exactly what it is that needs to get done, and ask him why he can't do it... If he's not doing his job, get on his case. He works for your friend. Like any employee, you can and SHOULD manage him.

If your friend has been in jail for over 7 months now, it's a tad late to do anything about this now. This should have been addressed the first 30 days after he was sentenced. You did not say how long he was sentenced and for what.

Hi excon and thank you to everybody who is helping me out there. The PD left me a message on my phone Friday afternoon. He said " there is no lawful way for me to get involved. I have to be very careful in giving you advice my job is quite narrowly defined by the state of arizona. There is no basis for me to do what you need done and it sounds like you need it done."
Does that not say "I can't get your friend out of jail because a higher court judge said he shouldnt be in there. Get a private attorney that isnt in bed with the court system like I am and youll be able to get him out."
And yes your right I will call him tomorrow morning and ask him point blank. "what needs to be done and why can't you do it?
    Thank you :)

Hey there he is charged with harassment and for failure to appear on 3 misdeamenors . In city court. And drug paraphernalia ( a baggie with crumbs of cocaine) (I mean dust like) in superior court.

The city court judge gave him a year for these bogus offenses which the superior court judge had said are bogus. He should GET 6 months max for this drug paraphernailia charge which he has done 7 already. In Arizona first time drug charges are 6 months probation available. (depends if the judge got laid or not the night before0 well obvioulsy not because he got jail.

What did you ask the PD to do that he responded that way?
