    Change of jurisdition
    I have sole custody through the courts in Camden Co. Ga.That order was issued in 1997. Now live Kenton Co. Ky, we have been here since early 2000. Does Kenton Co now have jurisdiction over my kids

    If the other parent lives in Camden Co. Ga-maybe.


    Some states have provisions for 6 months... NRS 125A.085 “Home state” defined. “Home state” means:

    1. The state in which a child lived with a parent or a person acting as a parent for at least 6 consecutive months, including any temporary absence from the state, immediately before the commencement of a child custody proceeding.

    2. In the case of a child less than 6 months of age, the state in which the child lived from birth, including any temporary absence from the state, with a parent or a person acting as a parent.

    Once a state court has made a custody determination, that state keeps jurisdiction over all matters concerning that child, unless:

    1. A court of the state with jurisdiction determines that the child or the child and a parent do not have a significant connection with the state, and evidence concerning the child's custody determination is not available in the state;

    2. A court of the state with jurisdiction, or any other state, determines that the child and both parents or acting parents do not reside in the state any longer.

    The GA court still has the order and is the court of record at this point, if you want to make changes to the existing court order you will normaly have to return to that court esp if the other parent is still living in that area. If both parents have moved away, it is possible to get it moved, but you will have to make motions to that court, and the other parent will either agree, fight it. So talking to an attorney in your new area will be all you can do at this point.

    As said GA still has jurisdiction over the case unless you petitioned the court to allow a change. It really isn't that hard to do most of the time. You just have to go to your county court that you reside in now and petition them to take over the case. You can call the clerks office if you don't know who to get ahold of and they will let you know or you can hire a lawyer and he/she will take care of it.
