Hey kiddo the answer is when you are 18. If your mom wants you to move in with her she can petition the court to allow you to move but it has to be her that does it so you might want to talk to her and see if she agrees with you. The judge will most likely allow you to testify as to where you live but it is still up to the judge to act on your best interest until you have turned 18.

Does your father have legal custody? Why?

If your mother petitions for a change of custody the Court will listen to you at 14 but probably only hear you out; at 16 you may have say; when you are of age you can go anywhere you want (in most States).

Normally there has to be some seroius reasons for a mother not to have legal physcial custody, so there may have been some things you are not aware of from the divorce and original custody.

You have no right to move until you are 18, So your mom, if she was going to get custody will have to go back to court.
