The father and child has not spoken except in a court ordered counseling at that time she confronted him re abuse. I have filed and have court hearing as he is fighting this as he is a control , abusive person.

Fighting what? That you move out of state? So you were awarded full legal/physical custody with no visitation because he abused your child? And you really think a court is going to refuse you the right to move?

I would stop worrying about it. In fact, I would file with the court that he pay your court costs if he loses.

Does the current custody order prohibit you from taking the child out-of-state?

If not, and if the father indeed has no right to visitation, there is nothing stopping you from leaving now.

To move out of state of Indiana. Custody order " mother to have primary legal/physical custody of child with no visitation unless the child request.
The order speaks nothing about moving out of state.

Really, looks more to me, like you forgot what name you were using to reply to the thread. Why the two different names?
