Cps received a report that drug use in the home and they were being neglected.we were asked to submit to a drug testing my wife and I both complied and our results came back negative however they are still in our lives wanting more drug testing,rehab,and have also requested that our 3 children are not to live with us until further notice as of now they have been living with my mother in law and we are only allowed to be around them as long as there is another adult or family member present so my ? First, read this. "Signing over rights" is largely a myth, except in connection with adoptions. If you want someone else to adopt your children, with you no longer having any connection with them, you might try it; otherwise no.

You should obtain an attorney to advise you regarding this situation. I seriously doubt that CPS has acted in this way without any evidence of dangerous behavior on your part. As the saying goes, "where there is smoke, there is [usually] fire."

CPS claims they do their best to place children with family members before putting them in the system so yes you should be able to take the steps in being guardian or having custody to keep them from going into the system.

No, first has AK said you can't just sign over your rights. If you did so it would be permanent. And even if you were to grant temporary guardianship to the in-laws, it would not stop the investigation as CPS would still be looking to protect the children.

I think you need an attorney to find out why they have taken these actions despite any evidence. Do you know who submitted the report to CPS?

If you are truly innocent, you follow every step and guideline set forth for you to get your children back.

You would have to sign full custody over to someone else, and it could not be temporary, and even then, most likely CPS would still finish investigation. Obviously you do not have an attorney representing you.. that is you next step, to get attorney and use facts that no drugs were present, and file for them to stop all investigation for lack of proof.

You need, if there is no truth to any report, go on the aggressive, but you can not do that without an attorney
