My ex husband is willing to sign his rights over. Do I have to agree to whom he signs them over to? We live in Idaho, I can easily get his rights revoked due to him abandoning the child by Idaho State law. And by Idaho State law he also has to sign them over to somebody. So, I was wondering if there's anybody in Idaho who knows the answer to my question.

The only person he can "sign them over to" is your new husband who you have been married to for one year, who is going to adopt him.

And of course it may not be as easy to take his rights either. If he fights it.

Where do you get the idea you can "easily get his rights revoked"? Children aren't property that can transferred around.

While it is possible he is quoting the law correctly, he is not dealing with the reality. Like I said children are not property that can be transferred around. If Idaho law does say he can transfer his rights to another person, that person would have to be your husband should you remarry. The only other way would be if you were out of the picture and he was transferring rights to relatives or an adoptive couple. But I don't think you would agree to that. As long as you are around.

This comes up frequently because NCP want to get out of paying child support, so they think they can just sign over their rights. But this is just a myth.
