Is there a Court Order?
In general, you would be free to do so, so long as moving the child doesn't interfere with the father's visitation rights. If the father is in prison, unless visitation is to occur in prison, it's difficult to see how such visitation rights could be affected.
As JudyKayTee asks, is there a court order for visitation? If so, what does it say?
