About a month ago I filled for child support afraid my spouse would do it in our later years, causing me to receive back child support.

The process is not yet finished (or even started, for that matter. We have a meeting scheduled next week.) and we have talked about it and agreed to have joint custody over my daughter. My spouse has no desire to be attached to my finances; only for my to be an active member in my daughters life. (physically, financially and emotionally)

Is there a way we can do this where neither parties have to pay child support even though I have already filled for child support?

In my State - NY - you can withdraw your petition BUT it is not recommended. If he does not comply with the agreement you could have problems. A Court Order can be enforced; an agreement between the two of you cannot.

If the Court is going to decide custody it will want to decide support.

I don't know what you mean about the father not wanting to be attached to your finances - he has a duty to suppor this child. On the other hand if she spends more time with him you have a duty to support the child.

Your lawyer and her lawyer make that part of the custody order... approved by the court... or someone might get greedy years down the road.

I am the father.. The mother is the one who keeps my daughter but I want to keep her just the same.. I visit her almost everyday that's why I want to just get joint custody.. Her mother has agreed (seeing my desire to be a part of my daughters life).. and she also has stated she is not after me financially.. she only wants me to remain in my daughters life..

I think it's a bad idea - things are good between you now but in the future - ? Who knows.

Where is the daughter going to live? That's who has custody, not the person who visits.

I wish I knew more of these "side" arrangements that worked out but somehow they always seem to be a problem.
