I have to pay child support for my son who at which I do not see at all because I don't get along with the mother. We were dating never married and she ended up getting pregnant. I haven't seen him in over a year and I just want to give up my rights and just give the mother full custody because I am unable to make my child support payments.

As the legal father you cannot sign over rights and stop paying support. Even if you COULD sign over your rights, the Court would order that you pay child support until or unless someone else adopts the child.

Is the support by Court Order? If so, go back to Court, prove that circumstances have changed and request a reduction in the support.

I realize you don't "see it at all," but that's the price you pay when someone "ends up" getting pregnant. If you don't believe you are the father, request DNA, although if there is a Court Order there already is proof of paternity.

I know it's a harsh lesson and it happens all the time but the Courts are not going to make the child suffer because you had a casual relationship with its mother and don't want to pay support.

If you WANT to see the child, go back to Court and request visitation.

You had 50% of responsibility for creating the kid... you are going to share supporting it until its of legal age.

Legally there is nothing you can do, in fact even if you were to give up your rights ( except for adoption of the child,) you still have to pay support.

As for as full custody, that is given in court in a custody agreement, does not effect your rights to visit or obligation of support.

If you do not visit your own child, that is just your own laziness for not filing in court for court ordered visits, you visit with the child not the mother.
