My ex told me she wants me to sign over my rights to our child and doesn't want child support from me either. I live in Texas and have searched about this but what can I do because she doesn't want me around her or the baby and the way she acts when I talk to her or even when I went to visit the baby in the hospital was very hostile and I get very stressed out and I don't need the stress because I have stress induced panic attacks. There is this myth that a parent can just sign over their rights to a child and be done with it. However, its ONLY a myth. You can sign any paper she gives you and it would be meaningless because only a court can terminate parental rights and they will be very reluctant to do so. I believe Texas law would require child support even if your rights were terminated. So, if the mother applies for public assistance, the state will insist she identify the father and go after the father for support.

You need to decide what you want. You have the right as the father, to be a part of your child's life. You can go to court and get visitation and joint legal custody. But from a practical matter the custodial parent can make it difficult on the NCP.

If you decide you want to be a father, then go for it. Stick to your guns and get your rights. If you decide you don't want the hassle, I suggest you get a notarized letter from her stating that she does not want you to be a part of your child's life and does not plan on asking you for child support. This will NOT be binding in court, but it MAY have an influence on the court if, in the future child support becomes an issue.
