If it was court ordered, then the answer is yes.

Since the court has ordered a DNA test, it means that your local area will allow him to challenge paternity,

Some areas may not allow this, but many will.
I guess the issue is, did your husband, sign, knowing he was NOT the father and thus committed fraud ?
