    We leave in Illinois my husband want to adopt my daughter she's only 5. He's been with us 3 years. And her biological dad is not been around since a year, and only a year he gave us money for childsupport. Since that my husband have been there for my daughter. And pay every single thing that she needs.

    I commend your husband for wanting to take on the responsibility, but a father's parental rights are not terminated merely because he hasn't paid child support or visited her. In other words, there is no way you can do this without some involvement on his part.

    Is the support he was paying court ordered? If it is, he is racking up back support daily. Try asking him if he would relinquish rights to allow an adoption by your husband since that would let him "off the hook" for support.

    You really need to see an attorney!

    If your ex is listed on the child's birth certificate or if he has been established as her legal father(either through court-ordered DNA testing or by signing a paternity acknowledgment form), then you cannot just allow your husband to adopt the child. The father has to be willing to allow it, unless you can prove that he is dangerous to the child and the adoption is in her best interests.
