I work at a daycare and one day four teachers and 20 children were at a public park. A little girl fell from the equipment and we walked back to daycare... as she was not compolaining of pain or whatevr. We called the parents immediately and they went to the hospital. She was admitted and we were investigated and the police case closed.

Two questions:

(1) Can the teachers be re-charged with anything? The case is clsoed and there will be no new evidence because we all told the truth and we were not found to be negligent, only the Children's Aid was not happy we walked back instead of calling 911.

(2) Who is at fault here?

The case was closed so no further action should be taken

It was evidently an accident so nobody is at fault.

If there are any dr/hospital bills the forms will most likely say something like where did the accident occur? The answer is who they will most likely go after for insurance purposes.
Such as playground... city owned... they go after the city's insurance.
At least that is the way they did it when my kids got hurt anywhere.

Are you talking about a criminal charge (the Police) or a civil case (lawsuit)?

I just investigated one of these yesterday - and the lawsuit is based on lack of supervision. Too few "teachers," too many kids.
