    Relinquishing Parental Rights
    I'm hoping someone out there can help up! PLEASE!

    My fiancé Chris has a daughter that lives in NY state. His ex will not take his calls or text messages when he tries to find out any info about his daughter. We have discussed it long and hard and have decided that we would find out info about him relinquishing his rights. Seeing the way the world is today... we are confident that his daughter will want to know who he is when she is old enough to do so and her mother will not be able to stop her at that time! Please help! Where can we get information on the procedure? Where do we even start looking?

    My advice would be to get an attorney and ask him or her. Unless Chris is an unfit parent, he should have every right to see his child, especially if he pays child support. You didn't mention that in your question so I'm not sure what the deal is there. I'm pretty sure he has every right to be in that child's life unless the mother can prove otherwise.

    A bit more info is needed...

    Is he on the birth certificate?

    Is there any court order for visitation and/or child support?

    What is his reason as to wanting to sign away his rights?

    He does have a visitation order in place - He is listed on the birth certificate - and he is indeed paying child support.

    Then he needs to take her back to court to find her in contempt for not allowing visits or contact.

    Even if he signs over his rights, he will still have to pay child support unless there is a new partner to adopt

    Why is he not having it enforced? Relinquishing rights because the mother is misbehaving is ridiculous. It sounds to me as if he is just looking for a way out of being a parent. If he really loved his daughter he would be fighting the mother in court. Relinquishing rights is very difficult to do and most courts would not permit relinquishment because the child's mother is acting like a witch.

    What exactly does he expect from relinquishing his parental rights? He's STILL going to be paying child support.

    Take the mother's butt to court and have her held in contempt for breaking the custody/visitation order.

    Well I am still confused for his reasoning of wanting to reliquish his rights...

    If he has all these things set up in court, he can easily hold the mother in contempt of court.

    Also, what confuses me most is when you state that you are sure then daughter will want to know who he is when she is older... if he were ever able to sign away his right he has NO legal right to that child, technically that child is no longer his... how are you going to explain that to the little girl if she does come looking for him?

    Bottomline, he cannot willingly sgin away his rights unless the mother is in agreement AND she has someone willing to adopt the child in his place.
