I don't think it's the last name that matters, but it the custody agreement that has been set forth by a judge. What is the custody agreement in your case?
The simple answer is no.
Regardless of the last name, it is the custody order that is the issue. The last name has no bearings.
And as far as the last name goes... you would have to get the fathers permission to change that as well.

Do you have to get permission to move your child to another state? If not, this may be a partial solution if you "fear the father" or have some significant reason to want to move your child out of country.Quote:

In other words, changing your son's name doesn't change the court orders that are binding on you. In fact, trying to get around those orders by changing your name would be considered fraud and illegal. It would make matters worse when caught, and you would be caught.
