He can't "sign his rights over" unless your current husband wants to adopt the child.

I don't have a husband.. so that's why I asked.. he doesn't want anything to do with his son.. he told us to burn in hell and get all the papers ready.. so I don't know what to do! :(
There is this myth that a parent can just sign away their rights. Buts it is just a myth. As the sticky you were linked to explains, its won't happen.
Since he wants nothing to do with your son, what do you think you will gain by having his rights terminated if it were possible? Why haven't you gone after him for child support. Your son is entitled to that financial support.
So he is the one telling you to get the papers ready? So you tell him there are no papers to get ready. That he helped conceive this child. That if he wants to not see the child or be a father to him, that's his choice. But he is responsible for supporting the child and you will be going to the courts to do so. But I would not tell him this in person. That's what you do.
I have tried.. he doesn't have a job so he can't pay..
