    Filed 1040 instead of 1040NR
    Hi,

    I just realised that I filed the wrong forms for both 2005 and 2006. I need help on how to file the amendments and the 1040NR.

    I came to the US on H1 visa on Sep 11, 2005 and left the country on Mar 5, 2006. I returned on Nov 22, 2006 with my wife and I am here till end of April, 2007.

    So, my total days in the US for 2005: 112
    Total days in the US for 2006: 105

    For 2005, I filed 1040 as Single and got refunds too. I also got State tax refunds.
    For 2006, I filed 1040EZ just recently as Married filing jointly and yet to submit my state returns for two different states. My wife got her ITIN two days back.

    Please help!

    You need to file Form 1040X and attach a properly prepared Form 1040NR or 1040NR-EZ for each year. I can help you do this for a fee. If interested, contact me at email below.

    This process does NOT affect your state tax returns. File them after you insert your wife's ITIN.
