    Wage garnishment
    Hello,
    I am new here and wondered if anyone knows if this is legal. I have had my wages garnished for the last few years. I was paying on a debt until health problems caused me to loose my full time job and am now receiving social security disability payments. I have worked a part time job for over 10 years and only earn around $60.00 a week before taxes this is the wages that have been garnished.
    I was under the impression that I do not make enough money to have my wages garnished. I live in Indiana so I am not sure if they are allowed to garnish wages when a person makes so little. I am being charged 8% interest daily on the balance so I doubt I could have even paid off the debt since most of what they take out of my check goes on the interest. Now I have to quit working because I have to have a knee replacement and my health has gotten worse so now the debt will get higher due to the interest rate. I had notified the court that I am disabled and provided proof as to how much I made at this part time job. Does anyone know if this is legal for them to do in the first place? I thought a person had to make a certain amount of money every week before a court could enter a garnishment order.

    Hi Pamm,
    I really don't know as to your level of income in general, though I know there are people here who will be able to answer that for you. What I can tell you is, that it is illegal for them to garnish your disability. So if this should to occur at some point, please notify all appropriate parties immediately.

    In many areas there is no low limit, any working wage can be garnished,

    Some states may have limits, I don't know of your state, you would need to check with an attorney in your area to be sure.

    I know here in TN they can, since various part time people who work for me, get their wages garnished all the time.

    Usually there is a percentage cap on how much of a paycheck can be garnished. Check with your employer. If you don't get a straight answer from them then check with an attorney.
