    Rental Laws
    My landlord is trying to evict me for having a pet. My last lease, which stated no pets, expired in 2003. Can she still evict me when I have no lease current lease stating you cannot have pets.

    If you have no lease you are a month to month and she could give you 30 days notice. If you have a lease and it does not mention pets I would contact an attorney

    Yes she can. The only thing that changes when a lease becomes month to month, is the month to month thing. If your lease says that you have to deposit your trash in a containter, you still have to deposit your trash in a container even after your lease expires.

    Why would you think that you couldn't have a pet for the first year, then you could??

    Yes, why would you believe it would not, The lease converts to a month to month rental, in that you are either following the terms of the lease, or on a verbal agreement. So at this point, they can merely just evict you, for no reason at all if they want to. Now all they have to do is give you a 30 day notice and you have to leave.

    But let me see, your old lease said no pets, your lease expired, you went to month to month rental, and you somehow believed the landlord all of a sudden was OK with you having pets??

    In addition if the original lease that went to month to month rental, stated you were to follow the terms of the lease on the month to month rental, the landlord can hold you liable for the costs of getting any pet smell or allergy issue out of the apartment.

    So get rid of the pet or move
