My boyfriend was arrested for dui about 5 years ago and was never charged with the dui in PA. it has been about 5 years now, he was not found quilty or not quilty, is there a statue of limitations on that charge

This is an interesting question, in GA at least when the officer arrests you, that is being charged with the crime, the DA can dismiss it, but the actual charge is the ticket the officer give them when they are at the police station with the handcuff ons.

Now this is the thing, Statue of limitation stops counting from the time you are charged ( arrested) for the crime, so he was was actually ticketed ( charged) then there is no time to run out. Although it sounds like it was dismissed for some reason.

He needs to have an attorney look into the matter, it could be the officer did not have probably cause, or perhaps the evidence was faulty and the DA did not continue with the case.
