    Small clains summons
    I received a small claims summons today. It is from midland credit management who bought a very old emerge credit card account of mine. On my credit report they are only reporting as midland credit with no open date. I know that the sol has passed because I have not had a emerge credit card for along time. I need to file a answer but am not sure what to say. Help please. They do not need to get away with this but do not have the funds for a laywer.

    File a Notice of intend to defend with the court, File MOtion to Dismiss with prejudice for SOL has expired. Don't admit anything.

    Thanks, I can do this myself right. Is there a sample of a motion to dismiss any where that I can use as a guide? Also, can I just put notice to defend on my answer that was attached to the summons. The motion to dismiss has to be filed as a separate thing right?
