    Form/Residency status/Dependent for student in US
    Dear Sir,

    I arrived in US in Aug 06 on a F1 visa. I am from India and married. My wife joined and my kid joined me in Feb 07 (on F2). I am only getting the assistantship/scholarship from the School and have no other income.

    1. Which form should I use?
    2. Can I claim deductions for my wife and child?
    3. Can I claim the deduction for Indian students (arising out of the Tax treaty)?
    4. What is my filing status? Can I file jointly?

    Kindly advice.

    1) Form 1040NR.

    2) Yes, if they have no income that is subject to U.S. taxes.

    3) Yes.

    4) You are filing as a married non-resident alien; filing jointly is NOT an option.
