    Florida Answer Complaint I Am Disabled
    I live In Florida now for 2 years. I moved from NY. I have a lot of debt that I was able to pay until I became disabled 3 1/2 years ago.They raised all the minimum payments and it got more difficult to keep up with. I have been selling it all off to keep up on the payments but I lost the battle.I have a mortgage and auto loan that I have been keeping up on, but no equity.I haven't been able to make payment on my credit cards since December. I was just served with court papers for 1 of the many debtors. I called the court and asked them what to do being disabled and they are no help. I have 3 young children under 8 and my wife has to take care of them and me. I receive work comp and SS disability. It not as much as you think. How do I answer this summons? Do I need a lawyer? Should I admit guilt? I don't want to do Bankruptcy but should I? I don't want to loose my house for my children's sake.. I know I owe the money but life just took a bad turn.If I was able to pay I would. Can you please help. Thank You...

    That part of your income is exempt, Work comp is not.

    This forum has many threads that contain advice for someone in your situation. I suggest spending time browsing through them.

    Its unlikely that the credit card companies will be able to take your house. So as long as you keep up those payments you should be OK there. Bankruptcy, however, may be your best bet.

    As far as the court, file your Notice to Defend. Show up in court and explain to the judge your situation and see what they say.

    Thank you everyone for the help. Is there a form or outline to use to answer the summons? I have been not answering the phone. Should I call them and explain my situation? I talked to Chase once and they wanted me to post date a check for them. I explained I don't have it. They didn't want to take no for a answer.They are out for blood. Thank you again for your time..

    I just researched 16 pages into this site and I am having trouble finding my answer on how to answer the court. I have never had to deal with the courts. Not even for a ticket.. Thank you again.

    There are forms, you can call the court and ask what format you need to use. But you really can just use plain language.

    AS for contacting Chase, send them a letter stating your situation and tell them all future correspondence should only be by mail.
