    Divorce From Citizen of Ukraine
    I was married 6-7-2005. My wife left with her clothes 1-16-07 for unknown reasons. She did not speak English very well. We had had minor problems involving her 23 year old son whom she missed very much. It was impossible to get a visa for him. She crashed the 2006 Toyota Solara I bought for her on 1-19-07. This I found out when the insurance company sent me a letter. The car was totaled. Shortly thereafter I received a restraining order . I had to hire an attorney and go to Burbank to defend myself. She told a lot of lies and the judge knew something was amiss and did not issue the order which was lucky because I could have lost my job. I served her with divorce papers at the court. I believe I may be the victim of a scam. Now she is trying to extort money from me and is asking for $2500 a month spousal support. I was only married to her for 1.5 years. I want to prevent this from happening to another U.S. citizen. She has to go for an interview for her green card next March.. she has one for two years. Can I notify ICE and have her deported back to Ukraine?

    Get an attorney if you don't have one. You can also hire an immigration lawyer to answer your questions. Are you from the US? I know that I married a non-US resident... he had no legal grounds (except for abuse on my part) to file for permanent residency if we were married less than 2 years. I expect the same is true for any non-natural resident in the US. (I am pleased to report we are still married and very happy... ) Contact a lawyer.

    Dear Vlee,
    Thank you for your response. Yes I am a US citizen (CALIF.). I have a divorce attorney. She has claimed that I have constantly abused her and I have never touched her which is what leads me to believe she iss trying to pull a fast one.

    Claiming she was abused gives her a legitimate reason (for INS purposes) to be allowed to file for divorce AND a could allow her to stay in the US even though she is no longer married to a US citizen. It won't be easy to prove if there are no police or hospital reports and no witnesses. Your lawyer should start rounding up character witnesses on your behalf, if you want to fight the cause for divorce, which I imagine you do. Ask your attorney if you can contest the reason your wife has stated for the cause of the divorce, without contesting the divorce itself. (I imagine you don't want to be married to this woman.)     To answer your other question, nope, there's no way to have her deported especially if she has a green card that is still valid. They may refuse to renew it if you can get the divorce finalized and prove that you never abused her.
