    Can my husband adopt my child without the biological father's consent?
    I am Filipino, my husband from Canada. He treated my child as his own child and he want to adopt my child ( 8yrs.old ) to use his surname but my child using the biological father surname, my child born out of wedlock. The biological father of my child never support my child and not seeing for 7yrs. And his location is unknown. I did tried to find him for 2 yrs. Now from old friends of him. But still can't be found. THANK YOU FOR SOME QUICK RESPONSE.

    Yes and no, It is much easier, and costs a lot less money, if you find him, and he gives consent. If not, you will need an attorney, and prove to the court that effort has been made to find him, The court in most areas have a process to go though,

    So it will take time, and costly but should be able to be done. First step will be trip to a local attorney.

    You will need to show the court that you have made a good faith attempt to contact the father. Your attorney (you need one) can explain what you have to do to satisfy the court. As long as you satisfy the court, they will, in all likelihood, grant the adoption.

    But where do you live now? What the others have said is correct, assuming you are in the US. Other countries may be different.

    Perhaps the Philippines and probably Canada, but we don't know whether she is in any of the three countries suggested in this thread.
