    OPT, H1B Married and Wife in India
    Please find my Visa status below.

    *Aug 2002 to Dec 2005 - F1
    *Jan 2005 to 20 Nov, 2006 - OPT
    *21 Nov, 2006 to present H1B
    *Home Country: India

    I went to India in Dec 2006 to get married and came back to US alone on 31st Dec, 2006. My wife will be in entering US in May 2007 on H4.
    My employer has provide me with two W-2, one for OPT and other for H1B.

    My questions are as follows.

    1. What will be my tax filing status?
    2. What should be my marital status? If my wife will be entering US in May?
    3. Can I request for Tax Extensions and file Tax after my wife enters US?

    You are NR and should currently file a 1040NR. In 2007 you will be a resident.

    If you want to you can file for an extension, then make the two elections once you qualify. This would permit you to be resident for the 2006 year. However, your worldwide income will be subject to US tax (and you should claim a foreign tax credit).
