Over a ten year period my social security disability money was deposited into what I thought and was told was an account separate from my husbands income. Now I have found out that he deposited the money into his personal account and in the last year paid none of my bills and I found this out when I pulled my credit report. Also Ihad less than 500 a month in bills so the rest was suppose to be left as a savings of sorts for me. Now after ten years he only says there is 3 thousand dollars of over 225 thousand dollars that was in his control. What do I do, can I file charges, I am overwhelmed and do not know what to do. I separated from him 10 months ago and am hiring an attorney through Catholic Charities for free to handle my divorce. Anyone know anything about my options.

Obviously your divorce attorney should look into what appears to be a diversion of your money to benefit your husband. However the bottom line is that, while you may be able to get the court to order him to repay you, one can't get blood out of a turnup.

If you never had a written agreement with your husband, you may have a tough time convincing anyone that you didn't know, that you never looked at your own bank statements for 10 years. Would you be willing to explain to us? Did your $500/mo expenses include costs for the home you shared with him, utilities, income and property taxes? It's a very low amount.

During the years of marriage, you had the ability to know where your money went. You could have for 10 years, seen depoist slips, see account balance. I see nothing illlegal ( but immoral) about his actions prior to separation.

After separation, you should have ( no one who is divorcing leaves their money with their ex) the money he took, during those past few months, may be able to be recovered though divorce.
