    Back support for adult child with disabilities
    I am trying to find information on how to collect back child support plus the 9% interest for my adult disabled child who is now 21. Oregon support enforcement told me I cannot collect any back support from the father, until his youngest child (6) reaches the age of majority. He lives with this child and mother but they are not married so there is a support order for him. Basically it's out of his pocket and into hers, which by the way is also his. Does that make any difference? I am going through a divorce and now am not able to afford all of our living expences. My daughter receives the full amount of SSI. I am paid to care for her at home through the state however, it's not a living wage, but it is enough to keep us from recieveing food stamps. (I do receive a small amount of child support from the man I am divorcing now for my 16 yr. old son with him) I cannot believe this can happen. It's not right. Also, they told me, that the case could get dropped all together because so many years will have gone by. He owes me $15,000. I don't know if the interest will stop as well from the day she turned 21. What am I to do? We really need this support money. I cannot work outside of the home due to her disability. I can't afford a care provider with her $ and SSI knows that. Any job I would get would be min. wage because I lack skills or schooling. (stay at home mom for her for 21 years) So basically I would have to pay to go to work? Oregon state support enforcement did not tell me I was not able to receive the back support until I asked them why I wasn't recieveing it, and they said they stopped collecting the day my daughter turned 21. WHY? They don't know why, they just do the job they are told to do. Seriously, that was what the guy told me. I tried calling the main office in Salem Or. But they just fwd me back to the Portland office and my case worker. This is really a waist of time dealing with them because they have no idea what is beyond 18- 21 yr. olds. Any ideas?

    Was your daughter disabled at the time of the divorce or breakup from her bio father? Also someone at Oregon support is either lying to you or is so inept that they dont have a clue.

    1) Arrears NEVER NEVER disappear. Period. The person that told you that is an IDIOT !!!!!!!!!


    2) If she was disabled at the time of the order then you should be able to have it extended. Yes even up to a lifetime.

    3) They should be collecting on the arrears already. They dont have to wait for other children to do anything. Your daughter is first inline and he can not use the excuse of having another mouth to feed to reduce his current support.

    4) Its the law. When a person is in arrears they can take up to 50% of what they make and that is before taxes.


    You really need to talk to someone competent in the law there or hire a lawyer through community services and get this straightened out right away. Any communications from the child support office should be in writing. If they say no to something then ask them to site the law and send you confirmmation in the mail.
