I have a room mate that was evicted from a veteran's housing program. I let him move in with simple rules. Pay the utilities for the house (this included internet), stay out of my room. My cost is approximately 400 USD a month for the rent his share is 140 USD give or take. This arrangement is NOT working. I want him OUT. The place I rent from is a month to month agreement. I have told my landlord about the situation and he wishes to remain neutral. It has been over 30 days so I can't just push him out the door. I live in Rock County in WI. The last time I tried to push him out the door he has made threats of physical harm, he keeps illegal drugs in the house, and everything I've asked him not to do he's done. It's gotten to the point I had to put a key lock on my bedroom door to keep him out. I'm at my wits end. Can I still serve him with a 30 day to vacate the premises? If so I know he won't sign that he received it so what's the best way to deliver this to him? I've tried to make this work and help him, but I honestly feel this is now a lost cause and it's only causing me stress.

If he's got illegal drugs in his bedroom... call the police and give them all the details. The next time he gets violent... record it on your cell phone... take that to the police as evidence. You might get him out even sooner if he gets arrested or you can get a protective order.

Don't serve him yourself... have a professional do it... he doesn't actually have to sign for it to be properly served... but if you have a disinterested third party testify he was served... particularly someone who does it for a living, he's going to have a tough time contesting it.

I believe you could do it, because he is technically subletting from you.....you both didn't enter the same lease with the landlord.

Your landlord is not involved here. This person is your tenant and you are his landlord. You evict him by following the process for WI. Generally, this involves a written notice to vacate within the statutory specified time. Then follow that up with a court order to vacate if he doesn't leave.

If he's doing drugs, or threatening physical violence, you can try calling the police on him and getting a restraining order.

Reporting the illegal drugs appears to be the easiest way to handle this. But I would be careful, lest the roommate try to claim that OP planted them. OP's consent will probaby be sufficient for the police to conduct a search.

And you need to be sure its really illegal drugs and sufficient quantities to interest the police.
