Need roommate to pay up or get out in VA
My roommate and I signed a lease in December 2006 for a year. We agreed on our rent and who would have which room and everything. I would pay the little bit of extra rent so I could have the master bedroom with the bathroom in it. Everything was fine for the first couple weeks, then she started complaining about being bored and not having cable or internet, and that she wanted to rent a washer and dryer that our complex would provide for $40 per month. We got the cable and internet and I told her up front before ordering it what the monthly cost would be, and she said that would be fine. We also got the washer and dryer so she would have to add 20 to her rent each month which was also fine. Each month when I get the bills in the mail I make a list for her stating the full amount of the bill and her half that she has to pay and the date they are due. December was fine. Even January was okay. February she started to slip, but I gave her the benefit of the doubt and let it slide that one time. March, I left her the list like every other month which she read and said she would have the money. Due dates came and went and she decided she would pay me when she got around to it. I had the money to cover it, but it's not my responsibility to pay her half of the bills and rent. I told her that this couldn't happen again because she needs to learn how to pay her own bills and I just don't have the money to cover it every month, or let her live there for free. This month, April, she did the same thing, paid late, had an attitude about it too. I don't understand how she can be rude to me when I had to ask her 3 times for the rent. She knew when she signed the lease what she was getting into so there shouldn't be any excuses right? Is there any way I can legally get her to get out? I write the rent and bill checks from my account every month and she pays me cash because she can't keep any money in her own checking account so she has no record that she has ever paid rent, but I also have no record that she hasn't paid rent. Help please!

If both your names are on the lease and the bills then you are in a bad situation. If she defaults you will be held liable for the totals. You need to create a better paper trail by issuing receipts for rent and bills paid, have her sign them. Without a paper trail you can't do much because you can't prove anything.
