    Tax Treaty
    Hi,
    I'd like to know if article 20 of Italy-USA treaty can be applied to my case too.
    I am an Italian citizen in the US with a J-1 visa. I have a post-doc fellowship at UT Southwestern Medical Center at Dallas. According to my payroll office the treaty can't be apply to a fellowship but I know a lot a fellows from other University to do it.
    Do you think I can use the treaty in my tax return and if yes what should I do since the payroll office sent to me a 1042-S without any exemption code? Can I fill an 1040NR-EZ and use a treaty anyway?

    I agree with the payroll department. You cannot apply the treaty to this fellowship.
