    Married international student
    Hi

I am an international student studying at UNC (from Iran). I came to US in 2012, and got married last summer (She is also from Iran). Now, for the tax return filing, how do you think I should file my tax? Married filing jointly? Or should we file separately? Can I include her as my dependent? (She did not have income).
Also, since she doesn't have SSN, does she have to apply for ITIN?

    Thanks
    Koushyar

    Koushyar,

There is NO tax treaty with Iran, so you must each file your OWN return (Forms 1040NR-EZ and 8843).

Your wife has no income, so no tax return is required, but she DOES have to submit Form 8843.

If you need professional help filing, please email me at the email address in my profile.
