    Unmarried fathers rights California
    My current child support was calculated wrong I redid the calculations myself And Ifigured out that I have my child 26 percent of the time which is not what I asked for but I was talked into this my current child support is set at 24 percent I know this isn't a big difference but it does help some also I am currently paying for childcare that doesn't take place all the time being that my ex girlfriend the mother of my son is a high school teacher and has lots of vacation time this is also affecting the arrears and causing a even higher amount for me to pay I'm not sure what I should do I want more time with my son and I ask for more time with my son but yet her lawyer said that I was not allowed to have him more than two consecutive nights due to his age he's only two years old I need to change this somehow..

    Who cares what HER attorney says, of course HER attorney will say what she wants him to. HER attorney will lie to you, cheat you and do what ever he can to get you less time and pay more.

    You hire YOUR attorney and file for what you want in court. Fathers can get up to equal time and extended visits.

    Visitation time is not figured by auctual but by what the court order says it is.

    There is no law in CA or anywhere I know of that would prohibit you from having him more than 2 consecutive nights. As Chuck said, why are you believing HER attorney.

    However, you don't say how long ago the court action occurred. Courts will usually not allow a modification for at least 6-12 months unless there is a substantial change in circumstances. So you may have to wait to file for a modification.
