    Felony Probation Violation
    Husband was arrested for probation violation for not checking in with p.o. He has been incarcerated for 3 weeks. Court is in 5 days. Original sentence was 90 days in jail and 3 yrs. On probation for possession of hydrocodeine for personal use. Served all his jail time. This is his first violation and no priors. We moved to NC and he is no longer a resident of CA. He had a warrant and he got pulled over for speeding and the arrested him. Can anyone give me an idea of what will happen?

    Why would he be arrested for personal use? Have a prescription? Labeled container with his name on it? Why didn't he transfer probation? Did he try?Courts in NC tend to be a bit more stricter. No attorney?

    He tried to transfer and p.o said it was not a possibility. The prescription was not his but it was jn his possession. There was not enough to charge him for intent to sale. I tried to hire a lawyer but they said his situation is pretty cut and dry. He just failed to check in with his p.o so the warrant was issued, and now he is incarcerated waiting to be sentenced.

"Pretty much answered your own question. With today's computers, you will get caught for even small infractions. Sorry but I believe he will do time-and maybe have to return to CA.
