I'm in a serious situation. A girl had been stalking me for months and being psychotic, preventing me from family friends and work while I helped her out of her own rut. Months after being put on probation for hitting me she wouldn't let me go and was still causing me any kind of trouble if I didn't see and be with her, and she started hitting and scratching me.

Long story short, I was hit minutes later with a hammer in the back of the head. The police acted as a friend for 2.5 hours then arrested me for Aggravated Domestic and False Report. They would have me believe it was a fire extinguisher, later told the prosecution I was intoxicated and fell on it. Considering the angle on the wall this is impossible. The allegation was written in an officers handwriting and they made sure she signed a 300 ft restraining order before leaving so I wouldn't be able to find out their goal was to plant evidence. Shortly after going from 1500 dollar bail to held without I remembered her saying something about the public defender I got seeing her mother on a personal basis. I told the defender there was months of evidence on the trail leading to this day which could be verified and he cut me off to tell me none of it would do me any good.

I took a plea, and am now waiting on a motion to vacate that plea. Since my re-entry to the world and start of probation I've talked to her, which my PO now knows. I have audio recordings not only of her telling me if I didn't call my friends to come pick us up so we could hang out with them she would put me in jail, but also admitting how she grabbed the hammer and hit me, heard it hit my skull and was hiding the hammer when the police showed up...





I haven't a lot of money but what has happened isn't right. She abuses her kid, has told me many times that the boy of not 3 years old wouldn't be fed until I came to see her because she "can't take care of my priorities unless you do what I need/ask." Many nights she would say she was going to kill herself.

The hammer thing happened while she was on probation, and told by her PO not to see me. So far, I don't think she's even got a violation of probation! And I don't know if my PO will be doing anything about it on a real note.

QUESTION: Where can I get a contingency lawyer that works civil but also knows some elements of criminal? I really need this and I'm running out of people to ask, thank you!

I always find that you need to find a former prosecuting attorney. They seem to make the best defense attorneys.

Why did you accept the plea if you were not guilty? That could be an issue.

If your recordings were not agreed to by both parties and you use them, you could be setting yourself up for a civil lawsuit. But that depends on where you live.

And why would you again contact her? You can't compound mistake after mistake and expect a good outcome.

Any attorney in the U.S. has to be familiar with both.. Both criminal and civil law are on the bar examinations in every state.

Repeatedly this woman has made Facebook accounts, slandered, shared pictures of the kids of women I've never spoken to who liked a post with psychotic headlines, threatened to stab or harm family and friends unless I've done what she asked. When I got out, that was to go see her. A lot involving the police had me shaky in the first place as it was being honest with them that put me in this position being that I didn't press charges right off. I was concussed and being questioned in the ER. The public defender was useless and I can't know if the "victim" was telling the truth or if he may have had a more personal interest in being my public defender. I didn't know who to trust and staying in jail with him as my right hand and the voice of average inmates to guide me didn't seem like an option. Most of my evidence which would establish her behavior over the course of months was located out here and I didn't have copies of it. My mind was weary and so many details were left out to why I was arrested to begin with. My memory and response time has been weakened since the hit with the hammer, especially when all this started and I had to make decisions from the inside. I felt cornered. My public defender revealed himself as a man who didn't want me taking it to trial, and wouldn't help me if I did or recognize usefulness in months worth of valid record, the audio not withstanding. I don't know what else to say at the moment. My mistake was not writing a statement and having pictures taken of my head right off the bat. When I asked if I had the right not to the Sgt of the PD said "well don't in call us next time.." and I was arrested soon after.

Once at the PD I was denied pictures of my injury, denied medical attention and food. I know what happened. I just need the help of a contingency lawyer, pending one sees enough wrong to pursue it. Any suggestions are welcome. I'm in the Southern VT area of USA. Thanks.
