So my parents don't like how old my boyfriend is, but he makes me happy and treats me right. Ya we had sex and it was consentual well we r 9 years apart but I'm 17 and he is 26. Can he be charged with statutory rape? There is a guy that wants me to sleep with him but I won't cheat on my boyfriend so he is mad and is like I'm going to turn him in for rape. I have proof you guys had sex. I was 16 and it was like once. Can he still get charged if I don't press charges?

Laws of consent vary by location. So depending on your location, yes he could be prosecuted. And yes, he should be prosecuted.

Aside from the law, and aside from what is right or wrong, I wonder what possible proof this sex blackmailer could have that you had sex, a year ago or a week ago?

Like, you, if like, the age of consent in your jurisdiction is, like, 17.

Your "boy"friend can be charged whether you "press charges"

If the age of consent is under 17, yes the boy can be charged if he is reported and there is proof. You can not agree to have sex, legally if you are under certain ages. This varies by location.

Also the parents have to agree just for you to date him, so them not knowing about him can lead to issues. Then also, parents can just order him not to see you again, and if he does, there are laws being broken then.

Where do you live? I think there are not many states that allow more than a 4 year difference if you are under 18.

The age of consent is less than 18 in many places.

"Each U.S. state (and the District of Columbia) has its own age of consent. Currently state laws set the age of consent at 16, 17, or 18. The most common age is 16.
age of consent 16 (30): Alabama, Alaska, Arkansas, Connecticut, District of Columbia, Georgia, Hawaii, Indiana, Iowa, Kansas, Kentucky, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Montana, Nevada, New Hampshire, New Jersey, North Carolina, Ohio, Oklahoma, Rhode Island, South Carolina, South Dakota, Vermont, Washington, West Virginia
age of consent 17 (9): Colorado, Illinois, Louisiana, Missouri, Nebraska, New Mexico, New York, Texas, Wyoming
age of consent 18 (12): Arizona, California, Delaware, Florida, Idaho, North Dakota, Oregon, Pennsylvania, Tennessee, Utah, Virginia, Wisconsin"

In other words, since OP was 16 at the time, there are (9 + 12 = 21) states where the BF could potentially be in trouble.
