    6th year F-1 student
    I'm under F-1 visa. This is my 6th year, so I cannot file as non-resident. The university did not withhold medicare and social security taxes. Is that OK? Do I need to do something about that?
    My husband is in his 5th year and has a fellowship, which is exempt for residents only. He has tax deductions on that but we want to fill jointly in 2007 as residents. How do we report the fellowship? If we include it in wages, it will get taxable. How can we include it as exempt with the possibility to get the money withheld back?

    You must file as a resident once you have exceeded the 5 years of F1. You are also required to have your FICA withheld but there is an additional exemption for students (resident or non-resident) who work on campus. You probably qualify under that exemption and thus don't need FICA withheld.
