    My child was receiving survivors benefits but has been in foster care while I have had legal problems.. do I get to receive them while she is in foster or wait to reapply when she comes home?

    You don't get support benefits for a child you aren't supporting.

    And if you don't report the situation to SS you are committing fraud.
