How long does it take to get a Court Order.
I have a dispute with Camelot the National Lottery at present and I am going though their complaint procedures at present. I require the name of the person who as cashed a winning ticket that I brought. The national Lottery as advised me to seek a Court Order to obtain the name of the person who as cash/stolen my lottery ticket from my home after carrying out major repair work. I was wondering how long it may take to obtain this Court Order to get them to comply.

Depends on where this is. Do you have proof the ticket is yours? What I think you should be doing is going to the police to report the theft and, in the meantime, seeking an injunction against the Lottery agency from paying out the prize.

    Judicial Review
    Hi Florence again,

Should I just wait to exhaust all of my options and go for a Judicial Review? Would the National Lottery have to provide the factual information to the courts of the person who as cashed my winning ticket?

First, please don't start a new question for follow up. I've merged your threads for you. Just reply to this thread.

Without knowing where you are and the local laws its hard to answer. I know of several cases in the US where people claimed that other people claimed their winning ticket. In some cases, there were criminal prosecutions for fraud and/or theft. In others, it was resolved with a civil case over ownership. So it could go either way.

Since you are claiming the ticket was stolen from your home, then it sounds like a criminal case and you should, immediately, go to the police.

If the police find your claim credible, they will find out who cashed the ticket and arrest them. If not, then you will have to subpoena the lottery records. In that case, you will need to convince a court that your claim is credible. So I ask again, what proof do you have that the ticket is yours?

If I were you, no I would not wait. I would contact a lawyer immediately. If we are are talking a large amount of money, and if you have a plausible case, many lawyers would probably be willing to consider taking this on a contingent fee.

Should you wait, the money might be gone and it will be too late to recover it.
