    Adoption question
    I live in Indiana and my son's biological father is in prison. My husband wants to adopt my son but we don't want to change his last name(my son has my maiden name and his bio father is not listed on the birth certificate). Does anyone know if there is a way to do this?

    You get the courts to get a DNA sample from the bio father and then you either attempt to show him as unfit. Or he simply signs off on the adoption. Your going to need a lawyer to wrangle your way through the system. But it can be done.

    You don't have to change his name as part of the adoption, especially if the adoptive father agrees. But you will have to identify the bio father to the court and you will need to either get his approval or show he has been served.
