Re-aging a debt
I have an account from Contact Resources. The origonal creditor has already fallen off my report. CRS has claimed I made a payment which is NOT to be true. I've sent a dispute to Equifax over 30 days ago, called the other day and they said its in processing! The collection agency is calling everyday! There no way they were able to validate that? Where do I go from here? Should I answer the phone, they sent me a letter, should I dispute with them, or will that re-start the sol. I'm in New Brunswick Canada. Thanks

A payment (or charge, if it's a charge account) starts the SOL running all over again. Even if the Statute runs the debt remains on your credit report, usually for 7 years.
Is that your question?

The date of last activity is Feb/2007 for the origonal creditor and that has come off my report as its been 6 years. But the collection account shows date of last payment Feb/2008... which is 100% inaccurate. Collection agency sent me a letter, I just don't know if I should talk to them or send a debt validation letter... or leave it until equifax finishes their dispute I've sent them. I just don't want the SOL to start over again. I'm just as confused as my questions, I think.

Whether you do continue to dispute it with the collection agency, or not, won't affect the SOL. If they sue you they will have to prove a payment within the SOL.

Equifax dispute
I disputed an inaccurate payment on my report in which once this is fixed, they will have to remove it from my report. It's been 45 days. How long does this typically take. Should I send a follow up letter, or wait longer?

Collection agency
I disputed an item on my credit report in which a collection agency reported an inaccurate payment which re-aged the debt by a year. I am still waiting for Equifax to investigate and validate and remove.. . in the meantime, the collection agency is continuously calling me and left a message statin "please call us, and here's your court case number". Now the "court case number" is the actual account number. Is it ironic that it's the same number?? Or is it possible they actually are suing me? I haven't received anything... is this legal tactics. I know it's past the SOL..

Tell them not to call you again. If they are reporting your account number as a Court index number they are committing fraud.
So do nothing, let them sue, prove it's past the SOL.
Equifax has nothing to do with a lawsuit over this. That's a credit report, totally different from a collection matter.
If you tell the collection agency not to call and they do call, report it to your State Office which handles these things - usually the Attorney General.

Thanks for the quick reply, sorry for asking the same question, I was just worried about the "court case" number they gave and wasn't sure if it really was a court case or if it was a scare tactic.

If you want to scare tactic them, next time they call tell them that misrepresenting where they are in the "litigation process" (giving you a false index number) has resulted in you filing a complaint against them. These things are NOT taken lightly.
Yes, I'd be sick of them, too, and tired of fighting over this. I'm a big believer that people should pay their debts. Life doesn't happen that way all the time.
Tell them to leave you alone - sounds like a nightmare.
No problem double posting. I should have realized it sooner.
I do investigations, and I am finding more and more of these false payments. The debt is out of statute but suddenly the creditor finds a payment! Now the debtor is arguing that the debtor didn't make the payment - sort of arguing against yourself.

Call the clerk of court (or whatever they call that official in Canada), and find out.
