We have lived in our current county for close to 2 years and got charged in another county don't they have to transfer to the county you reside in? They didn't fill out any forms just straight up said they weren't transferring.

How close are the counties ? They allow you to live at current address?
I guess the issue is, what problems this is causing.

Over an hour apart and yes they let us live here, it's our home we own it.

You were charged and convicted in County X, although you reside in County Y? No, they don't have to transfer your probation, if that's what you are trying to ask.

Couple things... Are you talking about NEW charges that they won't transfer, or your probation??

Something is amiss here.. There IS a local probation office, but they're supervising you from ANOTHER county?? I understand why you don't want to travel to THAT office, but it's also STUPID for that PO to have to travel to YOUR county.

They just don't do that. When I was on parole/probation, I could live in ANY county I chose as long as I didn't leave the state.

So, if you give US some details, we can give you a much better answer..

I don't know where you live, but I'll bet that only 50% of the crimes committed in a county are committed by RESIDENTS of that county. If my numbers are even CLOSE, that means people are crisscrossing all over your state..

Like I said above, I don't believe that's happening - which is GOOD for you.. If you can show that they're making you travel as ADDITIONAL punishment, then you can get it transferred.

The FIRST thing you have to do is acquire the state probation RULES/Policy and Procedures Manual.. In it, there WILL be a policy about THIS situation... IF, as I suspect, it says that you should be supervised by the PO office in the county where you live, then you have them by the balls...

However, it's MY bet that simply asking for that manual will get you transferred. If not, get back to us, and we'll ratchet things up.

It's a really shady county, were in Minnesota. It's the probation we want transferred and it does state in the paper work that it should be transferred the PO is OK with it transferring and so is her boss but it's her boss's boss that said no without even doing up the paperwork. The PO says to wait 45 days and then file a motion to get released from probation because we paid the restitution and fines and it wasn't a violent or sexual or drug related crime. My husband needs to travel for work it's what he does and with five kids to pay for he needs to keep this job. Even the judge and prosecuting attorney state they want him to keep his job but probation is screwing with him. They told him initially if he paid the 15802.65 in fines and restitution he would be released from probation. In the paperwork it says 0-3 years and they gave him the full 3 years!! He won't be able to get a job with a felony so why would they want to do that to a family is beyond me. Any info or direction would be greatly appreciated. Thank you both very much.

And we did pay ALL the restitution and fines the day of sentencing.
