Do you owe additional tax to NY state? If not, and you are filing the Form IT-203 to claim a refund or additional refund from your 2008 NY state tax return, do NOT bother.

You have passed the three-year statute of limitation for claiming refunds. ALL of the states follow the IRS model on that 3-year statue of limitation. Any amendment or late filed return will be accepted, but NO refund will be issued.
